"Bending your back" was always considered a figurative term in rugby league, but last night it formed the basis of Wests Tigers' successful defence against the grade-three crusher charge handed out to winger Beau Ryan.

Ryan succeeded in having the charge downgraded to a grade-two offence, meaning he will be free to play Parramatta in round three, after a tackle on Manly's Michael Robertson in the 65th minute of the Tigers' 26-22 win last Monday.

Judiciary counsel Peter Kite had argued that Ryan's tackle was on a par with a grade-three offence by Gold Coast forward Matt White on Penrith fullback Lachlan Coote last year, however, the three-man panel of Ian Roberts, Sean Garlick and Don McKinnon disagreed.

Ryan's representative, Geoff Bellew, SC, said ''whatever bending of the [Roberston's] spinal column … was momentary''.

''There was no sustained pressure and whatever pressure was exerted was not done with his [Ryan's] full body weight,'' he said. ''Once he's on the ground there's no attempt to hold him there. There was no attempt to keep his spinal column flexed.''

Bellew said the tackle ''falls towards the lower end of the [dangerous contact] scale''.

''It is ridiculous to suggest that what is being done there [by White] is in any way comparable to what was done in Beau Ryan's tackle,'' he said. ''White and Beau Ryan can't sit together on any objective circumstance.''

Kite argued that the tackle had left Robertson ''effectively helpless'' and said it was ''more serious than White's tackle''.

He added there was ''a degree of control and explosive force'' by Ryan. ''While the offence is not prevalent, it's an offence of serious concern, one the judiciary code looks to stamp out,'' Kite said.

After the hearing, Tigers chief executive Stephen Humphreys said the club's appeal was largely based on the fact that the White tackle was being compared to Ryan's.

Earlier, Manly prop George Rose accepted a one-match ban after being charged with a grade-four high tackle on Daniel Fitzhenry in the final minute of Monday's clash. Manly coach Des Hasler said he still felt the grading was ''harsh''. Link
